Their purpose is\u00a0to spur economic growth and job creation in low-income communities while providing tax benefits to investors.<\/em><\/p><\/blockquote>\n<p>The legislation passed with bipartisan support.\u00a0 The Republicans liked the tax savings, while the Democrats liked the investment in under-developed neighborhoods.<\/p>\n<h2>Where are the Opportunity Zones?<\/h2>\n<p>Congress left it to individual states to determine what areas would be designated as an Opportunity Zone.\u00a0 (<em>See<\/em> <a href=\"https:\/\/www.irs.gov\/pub\/irs-drop\/n-18-48.pdf\">List of Designated Tracts<\/a>)\u00a0 There are some nice interactive <a href=\"https:\/\/opportunityzones.hud.gov\/\">mapping tools<\/a> available online as well.<a href=\"https:\/\/myhlaw.com\/es\/real-estate-investment-what-money-qualifies-for-opportunity-zones\/oz-legend_001\/\" rel=\"attachment wp-att-3091\"><img decoding=\"async\" class=\"size-full wp-image-3091 alignright\" src=\"https:\/\/myhlaw.com\/wp-content\/uploads\/2022\/04\/OZ-Legend_001-1.jpg\" alt=\"\" width=\"247\" height=\"235\" \/><\/a><\/p>\n<p>With some notable exceptions, you can expect opportunity zones to be neighborhoods traditionally considered \u00abunder-developed\u00bb or \u00abdisadvantaged.\u00bb<\/p>\n<h2>Projects Permitted by a Qualified Fund<\/h2>\n<p>Keep the purpose of the legislation in mind, you will understand why Qualified Funds (QFs) are not permitted to invest in just any kind of project.\u00a0 Here are some of the guidelines.<\/p>\n<h3>New Construction<\/h3>\n<p>QFs are not allowed to buy a property and simply throw some paint on it.\u00a0 The project must be brand new construction or a \u00absubstantial rehabilitation,\u00bb which means the QF put more money into the improving the property than it did to purchase the property.<\/p>\n<h3>\u00a0Examples of Qualifying Projects<\/h3>\n<p>Generally, QFs are expected to invest in projects that bring a benefit to the community by creating jobs or otherwise.\u00a0 Some examples include the following:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Affordable Housing<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Community Revitalization<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Economic Development<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Infrastructure Investment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mixed-use Development<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Multifamily Residential<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Renewable Energy Investment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Single Family Residential<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Small Business Development<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Workforce Housing<\/span><\/li>\n<\/ul>\n<h3>Profitability<\/h3>\n<p>Naturally, an important aspect of the projects is profitability.\u00a0 You can expect good QF managers to make strategic decisions when determining what projects to undertake in the Opportunity Zone.\u00a0 After all, investors not only receive the capital gains from the projects, but they also participate in the yearly cash
